Can I get a divorce in England?

If you have a permanent residency here, you can also go through the divorce proceedings in the UK. Divorce proceedings usually take place in an English court when the spouses have joint property or credit obligations. As of 6 April 2020, the Divorce, Dissolution and Separation Act reforms the legal requirements for divorce and the process thereof. It eliminated the legal requirement to make accusations about spousal behavior thus allowing couples to divorce by mutual consent.

The law also sets a minimum period of 20 weeks from the start of the court proceedings to the application for a conditional order.

This gives couples a meaningful period of reflection and an opportunity to reconsider the decision to divorce. The state application fee is £ 593. In some cases, the state reimburses this levy.

How does divorce take place in England?

Divorce takes place in three stages:

  • The first stage, during which the marriage is actually dissolved and stricken off the registry.
  • The second stage, during which the place of residence of minor children and the amount of maintenance is determined.
  • The third stage covers all financial issues, such as the division of assets or addressing the expected conditions for the further fulfillment of the obligation to creditors.

Under the new regulation, divorce can no longer be contested unless on jurisdictional grounds.
